Memorandum of Understanding Concerning High School Teachers -Additional Teaching Period (Overtime Indicator) and Impacted Preparation Periods

This Memorandum of Understanding (“MOU”) is entered into this day of November 2023, between the Chicago Board of Education (“Board”) and the Chicago Teachers Union (“CTU” or “Union”) (collectively, the “Parties”).

WHEREAS, the Board and the Union are parties to a collective bargaining agreement effective July 1, 2019 to June 30, 2024 (“CBA”);

WHEREAS, Appendix A-3A of the CBA establishes additional rates of pay for high school teachers teaching an additional class period during the regular school day pursuant to the overtime indicator;

WHEREAS, the parties dispute whether high school teachers teaching an additional class in accordance with Appendix A-3A of the CBA, who teach the additional class during their duty-free preparation periodprovided for in Article 6-1 of the CBA, are required to work their preparation period on site before or after their regular work day;

WHEREAS, Teachers’ duty-free preparation period is part of the regular school day under Article 6-1 of the CBA;

WHEREAS, Article 27-5 of the CBA provides when a teacher’s duty-free preparation period is canceled so the teacher can cover the class of an absent teacher, a teacher’s missed preparation period is to be made up by the end of the next academic quarter to the extent practical, and if not made up, the missed preparation period is considered lost and is paid out at the teacher's regular hourly rate; and

WHEREAS, teaching an additional class during a duty-free preparation period does not equate to canceling a duty-free preparation period and/or missing aduty-free preparation period. NOW, THEREFORE, the Parties agreeas follows.

  1. The WHEREAS clauses set forth above are reiterated herein and incorporated into this MOU.

  2. Effective this day of November 2023, and for the duration of the school year 2023 -2024, high school teachers teachingan additional class pursuant to Appendix A-3A, who teach the additional class during their duty-free preparationperiod, may work their corresponding duty-free preparation period offsite before or after their regular work day.

  3. In consideration, the Union agrees as follows:

    1. Even though the duty-free preparation period may be completed offsite, teachers are expected to act with integrity and maintain fidelity to comply with the same teaching responsibilities as if the duty-free preparation period were completed onsite; and

    2. Teachers who teach an additional class and do so during their duty-free preparation period are not entitled to a make-up preparation period under Article 27-5 or otherwise. The preparation period shallnot be considered canceled, lost, or entitle the teacher to pay. This is true regardless of whether the teacher elects to work the corresponding duty-free preparation period offsite or onsite.

  4. This MOU is not precedent setting nor does it establish past practice.
